The above is a quotation of the ninth amendment to the Constitution, found in the Bill of Rights. the ninth amendment never really gets talked about much in today's world, but the founding fathers most certainly must have felt that it was important enough to include into the Bill of Rights. So what does it really mean? I wonder....
As one who strongly believes that the Constitution was written to be a living document that was to be easily read and understood by the common man, absent any requirement for discernment or juxtaposed legal explanations, I have to believe that the Constitution was never intended to be a document to be interpreted or debated. The Constitution was and is a document to be followed and adhered to as it is written. And as such, the purpose of the Supreme Court was to insure that the rights granted and guaranteed in the Constitution would be protected as written
Therefore, if you want to understand what the ninth amendment means? Then simply read what it says. And what it says is this, regardless of the rights enumerated in the constitution, there is nothing in those enumerated rights that exists to "deny or disparage others (rights) retained by the people."
And the ninth amendment is followed and supported by the furtherance of the same beliefs in the tenth amendment. "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." So once again, the Constitution clearly states that what is not in the Constitution is retained to the states and the people.
The first amendment guarantees the right to free expression of religious beliefs, yet the 9th Circuit Court of appeals has ruled that as it concerns homosexual rights, your rights as a God fearing heterosexual Christian cannot be in conflict with the secular humanism of egalitarian supported homosexuality.
Therefore, what the US Constitution must really be saying is, that all rights not specifically enumerated, are retained exclusively to the courts for their periodic review and are to be used to purposely back up and support secular humanism and egalitarianism to the exclusion of all other rights.
The word that best describes what is occurring in the courts of this land is "abomination." And the word abomination fits squarely with the biblical descriptions of homosexuality and the teachings of Christianity that homosexuality is an abomination. .
California Prop 8 ruling on gay marriage overturned
The U.S. Court of Appeals for the Ninth Circuit Tuesday ruled unconstitutional Proposition 8, the 2008 California ballot measure that banned same sex marriage.
“Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples,” Judge Stephen Reinhardt wrote in the majority opinion.
