Ron Paul upset over lack of Due Process for terrorists
Ron Raul is distressed that the United States had the opportunity and took the shot and killed the avowed anti American cleric and Jihadist Anwar al-Awlaki. Paul believes America was wrong to deny this vermin his supposed "due process."

Let's see, there were over three thousand Americans who were killed on 9/11 by Al Qaida operatives. Where was their due process on September 11, 2001? And what about the six thousand Americans who have died in Iraq and Afghanistan, hunting these vermin down? Where was their due process?
Here's a clue Ron (and the rest of you Paulistas listen up) We are at war! There is no due process in war! There is no fairness or equality in war! There is no legal framework to extend American constitutional rights to enemy combatants and those sworn to kill Americans in war!

Presidential candidate, Rep. Ron Paul, R-Lake Jackson, harshly criticized President Obama today for ordering the U.S. drone strikes that took down a high-profile Al Qaeda leader in Yemen today. According to the the Associated Press, U.S. and Yemeni officials confirmed that Anwar al-Awlaki, an American citizen, was killed in a CIA-led strike that teamed with U.S. Joint Special Operations Command.
Time reports that the operation was carried out by the same unit that killed Osama bin Laden. Paul condemned the president, telling reporters after a speech he gave in New Hampshire today that he thinks it’s sad Americans “blindly and casually” accept the president assassinating people whom he feels “are bad guys.” “No I don’t think that’s a good way to deal with our problems,” Paul told reporters. “He was born here, al-Awlaki was born here, he is an American citizen.”I wonder how many Americans have been afforded their 'due process rights' by Anwar al-Awlaki, How many times have those that he has led and been associated with concerning the deaths and murders of Americans, stopped and said: "wait a minute! These people have rights!"

Searching for words, the president lets slip a significant piece of his reality during this interview. And that reality speaks volumes in my opinion. There is absolutely no association or connection made by his mind, that America's downward spiral competitively and economically, has anything at all to do with policy. Especially not his policy.
No mention of NAFTA or the myriad of federal regulations or EPA decrees that have been enacted to hobble and destroy industry after industry in this country over the last twenty years. No mention of the polices that he has enacted, or the other policies that are looming to be enacted, especially his environmental policies. No, none of that. Obama's simple revelation is that America has gone soft, no more, no less. Therefore if you are looking to assign blame? Assign it there.
That's what comes to his mind. And to think, that this is just a peak in the mind of what he must really think as it concerns this country and it's people. I would imagine, he actually believes that we as a nation are precisely where he and others want to see us at this juncture in time and he as his regime are quite content to continue to witness and steer that demise toward oblivion.
So....Let's recap the Obama presidency to date. First everything was Bush's fault, then everything was congress' fault and now? Everything is America's fault. But it certainly isn't Barack Obama's fault.

Our First Lady

What was so important? That the first lady has to go to Target (or anywhere else for that matter) for two small bags?

Cain's blood in the water moment
Since his surprise victory in the Florida straw poll, the media has suddenly discovered Herman Cain. As of last night, he was being reported by most media sources as a firt tier candidate now. But with that surge in popularity come the price of liberal media scrutiny. Specifically, the interview with Wolf Blitzer below. I would call that a blood in the water moment.
Blitzer asked the setup question and Herman Cain responded honestly, but you can immediately see and sense Blitzer's
antennae going up on Cain' s answer. Herman Cain answered the question truthfully, but that answer will not play well with America's leftist media.Look for them to return to this sound bite repeatedly as Herman Cain gathers more support.

We know what's good for you....
So....once again the camel's nose of egalitarian fairness first peeks into the tent, then the camel moves on in.
Which leads to my title for this blog. We know what's good for you. Apparently, once again the egalitarian concept of fairness has crept into yet another aspect of our lives.
It's not fair for anyone to have a greater survivability aspect than the next guy right? So we have to make it fair. And I wonder, just how did the Insurance institute and the auto makers approach that aspect? I am pretty sure they accomplished it by reducing the survivability of SUVs and pick ups. That would make it more fair right?

Redesigned Front Ends of S.U.V.’s Have Led to Fewer Crash Deaths
Sport utility vehicles and pickup trucks on the road today are far less deadly in frontal and side-impact collisions with passenger cars and minivans than earlier models, according to a study released Wednesday by the Insurance Institute for Highway Safety. The institute, a nonprofit financed by the insurance industry, attributed the findings to a voluntary effort between itself and automakers that began in 2003.
Automakers pledged to revise the front ends of their S.U.V.’s and pickup trucks so that they would be less likely to kill passengers in a smaller vehicle during a collision. Modern S.U.V.’s and pickups, the study found, were no more deadly than modern cars in front-to-front and front-to-side crashes, provided the S.U.V.’s and cars were of similar weight. None of these results, however, contradict the basic laws of physics in a crash, said Joe Nolan, the institute’s chief administrative officer and the study’s co-author, in a telephone interview.
“Your vehicle’s mass makes it worse for other people,” Mr. Nolan said. While a mismatch in vehicle mass would still heighten the risk of death, Mr. Nolan said that the geometric “compatibility” among S.U.V.’s, pickups and cars lowers the risk. “In the past, you had both a geometry mismatch and a mass mismatch, leading to a pretty bad problem,” he said. The study examined S.U.V.’s, pickup trucks, cars and minivans that were one to four years old in 2000-1 and looked again at vehicles that were one to four years old in 2008-9.
Researchers separated each of those vehicle classes into weight categories that ascended by 500 pounds. Next, they compared the number of occupants killed in two-vehicle crashes between cars and minivans exclusively. The study did not correct for the size of the vehicle occupants themselves, so in the testers’ data, the people who were killed could have been of any age, size and weight.So there you have it, problem solved, but not really. Because if you paid attention to the language in the report, even reducing the survivability for SUV drivers doesn't completely accomplish the set goal of "fairness." The findings concluded: "provided the S.U.V.’s and cars were of similar weight." Which means?

The Iranians have once again challenged America and this time they are literally threatening us.
Iranian Navy Plans to Send Ships Near U.S. Waters
The Iranian navy plans to move naval vessels out of the Persian Gulf and into the Atlantic Ocean, "near maritime borders of the United States," the Tehran Times reported Tuesday. According to the English-language paper based in Tehran, the announcement came from a top Iranian naval officer on Tuesday. “As the global arrogance (forces of imperialism) have a (military) presence near our sea borders, we also plan to have a strong presence near the U.S. sea borders with the help of the soldiers who are loyal to the vali-e faqih (supreme jurisprudent),” said Rear Admiral Habibollah Sayyari, as quoted and paraphrased by the Tehran Times. "We've been pushing freedom of the seas for years and the Iranian navy can go wherever it wants," said Pentagon Spokesman Capt. John Kirby.This is a forty year old ship, bearing one 5 inch mount; therefore, as a weapon this ship poses little threat to America or anyone else. One of our Perry class frigates could vaporize this rust bucket while never actually having to come into visual range of it. But the point that is being made remains. By sending this ship to our doorstep, a message is being sent. The same as if an obnoxious neighbor down the street were to send its dog to come take a crap in your yard.the actual threat or damage is not at issue, it is the intended insult that matters. This is lthe little tin dick Iranian dictator's way of throwing a shoe at Barack Obama. And this administration and American media don't have sense enough to either see it or interpret it for it's intended meaning.

MSNBC calls AP racist
And what happens when you don't drink the Kool Aid or you simply report the facts as they are? Well of course you must be a racist. Is there any doubt that the president's major re-election theme for 2012 is going to be four more years to save his legacy and combat the racism that has prevented him from attaining his place in history as divine glory?
Of course he won't have to say it, but they are already lining up in leftist media to launch racism as every opportunity. Even against their own.

During his speech, Obama attempted to fool the black audience into thinking he was one of them and not a paid teleprompter reader for Wall Street by dropping the g’s at the end of his words. “Take off your bedroom slippers. Put on your marching shoes,” Obama lectured the audience. “Shake it off. Stop complainin’. Stop grumblin’. Stop cryin’. We are going to press on. We have work to do.” However, after the Associated Press accurately transcribed Obama’s dropped g’s, MSNBC aired a debate segment asking whether the decision not to “clean up” Obama’s words was “racist”. “On MSNBC, the African-American author Karen Hunter complained the news service transcribed Obama’s speech without cleaning it up as other outlets did–specifically including the “dropped g’s,” reports Yahoo News. “Hunter called the AP’s version “inherently racist,” sparring with New Republic contributing editor and noted linguistics expert John McWhorter, who argued the g-less version “is actually the correct one,” noting that the president’s victory in the 2008 election was due, in part, to how effortlessly “he can switch into that [black] dialect.” It goes without saying that Hunter’s claim is completely ridiculous. Obama’s dropping of his g’s was blatantly deliberate. If the AP had “cleaned up” his speech it would have been completely misleading and inaccurate.

I don't recall the same testiness or grim faced looks from the then president. If you wanted to get George Bush angry, then you had to launch baseless lies at him. He would respond to those and IMO, gave some of his best speeches in the face of accusatory vitriol.
Where as Obama seems to immediately lose that poise and whimsical smirk once he senses the dialogue is not going to be favorable toward him or his policies. Combine that uneasiness with the absence of a teleprompter and the stage can easily be set for what I would equate to a "Col. Nathan Jessep" moment. All it would take would be the right priming of his emotional pump and I believe we could see Obama "go off" and potentially spill the beans on himself.

Maxine Waters doesn't know who Obama was talking to
On the heels of Saturday's speech by the president to the congressional black caucus, Maxine Waters is one of many questioning the president's speech. Albeit she avoids any outright attack on Barack Obama, her sentiments show through. Maxine Waters is obviously upset over what she considers the "curious words" that the president used to address the CBC on Saturday.
"Curious words" is a code phrase that strikes directly at what Waters and other CBC members know was a direct slap at them by the president. Albeit she doesn't want to give the impression during her media interview, that she and the rest of the CBC got their comeuppance from the man in the big house on Saturday.
Maxine Waters on Obama "I don't know who he was talking to because we're certainly not complaining," Waters said on CBS' "The Early Show." "We're working. We support him, and we're protecting that base because we want people to be enthusiastic about him when that election rolls around." "I found that language a bit curious because the president spoke to the Hispanic Caucus, and certainly they're pushing him on immigration... he certainly didn't tell them to stop complaining," she said. "And he would never say that to the gay and lesbian community, who really pushed him on Don't Ask, Don't Tell."Rep. Waters can obfuscate all that she wants to, but she knows precisely who he was talking to. The bottom line is this. Everyone knows who the president's remarks were aimed at Saturday. Those remarks were aimed directly at Maxine Waters and the rest of the CBC who are not in lock step with Obama's programs and policy. Specifically as it applies to jobs and the unemployment rate among blacks. Waters knows damn well that blacks are taking a brunt of the effects of this recession and unemployment. As she equally knows who is responsible for the ongoing reality of unemployment in the black community. But she nor the rest of the party's plantation overseers should be saying anything about it or else. You can bet, Maxine heard the president's message clearly and she saw the podium slap as a signal. .

It seems, that since Commissioner Kelly was given a demonstration of the Barret 50 caliber sniper rifle? He some how believes that it has applicability and adaptability to civilian anti aircraft use. Seriously? Apparently so.
So let's have a look at this concept and a potential scenario where it might be deployed. Terrorists have once again seized a number of aircraft in America and once again the American military is ill prepared to respond to a shoot down order (as if one would be given by the current administration.) So, Commissioner Kelly asks Mayor Bloomberg for permission to shoot down aircraft head toward downtown New York City..
Approval is (theoretically) given and a Barret 50 equipped NTPD "helicopter" is dispatched to an intercept course with a 350,000 plus pound aircraft, traveling between 350-450 miles per hour. So there you have it. The NYPD seems to believe that they can pull off with a sniper rifle, a 10,000 to one shot against a moving target traveling hundreds of miles an hour and they are going to do it from an aerial platform, completely incapable of matching the aerial capabilities of their intended target.
What's more troubling is that the commissioner and the mayor of New York actually believe that they could get away with shooting down a commercial aircraft and killing dozens if not hundreds of Americas on the plane and at the same time limit or eliminate potential collateral casualties on the ground? Which could also run into the hundreds?
The only thing more absurd that this supposed plan by the NYPD commissioner, is that anyone would actually conceive it to begin with. Much less that it would be reviewed and approved by the mayor of New York. (UPDATE) NYPD Plane-Takedown Capability Does Not Include Jetliners: Sources It's still a stupid plan....
New York City police have the capability to take down a plane if the need arose, its chief has revealed. Commissioner Ray Kelly said that the NYPD has weapons powerful enough to shoot down an aircraft out of the sky in an extreme situation. The 70-year-old police chief said he could not rely on the federal government alone to respond to a terrorist attack.So where did that capability come from? Since this story broke over the weekend, some sources in the media have assumed that the weapons capability being referenced are surface to air missiles. Thankfully, that isn't the case. Apparently the NYPD is looking to another weapons system to accomplish that which they fear the federal government may not be capable of doing. Have a look at this....

After this weekends victory in the GOP Florida straw poll, many pollsters and pundits alike are madly trying to find a handle on why and how Herman Cain succeeded in upsetting the party apple cart and trouncing the two front runners.

After a few caffeine-heavy refills at our corner table, I asked him about President Obama's new effort to raise taxes on the wealthy, and Cain just about blew a blood vessel--especially when I mentioned the part where Obama says it's about "math" not "class warfare." "Can I be blunt? That's a lie," Cain said, before the sound of his voice began to rise noticeably higher.
"You're not supposed to call the president a liar. Well if you're not supposed to call the president a liar, he shouldn't tell a lie. If it's not class warfare, it's highway robbery. He wants us to believe it's not class warfare, oh okay, it's not class warfare. Pick my pockets, because that's what he's doing!"
Cain paused, took a breath and looked at me. "I'm not mad at you, I just get passionate about this stuff," he said. "I have to tell people because I get so worked up . . . . I'm listening to all this bullshit that he's talking about, 'fairness' and 'balanced approach' to get this economy going."
As anyone who watched the past couple of debates knows by now, Cain has his own plan that he says would steer the country out of its economic downturn. He calls it the "9-9-9 Plan," and it would replace the current tax code with three flat, nine-percent federal taxes on income, consumption and business. "With 9-9-9 guess what? How many loopholes?" he said, tapping his fingers on the table like a drumroll. "None. Everybody gets treated the same. What a novel idea."

Homeland Security may not be the only problem.
A lot of conversation and a lot of ink have been spent recently concerning the powers of Homeland Security and the tools being deployed to counter terrorism threats in America. Some conspiracy theorists still maintain that 9/11 was an inside job, while others believe that at least one of the planes that day was brought down by friendly fire as opposed to the "Let's Roll" scenario that has been popularized since the crash of flight 93 in Shanksville Pa.
But what if there were other entities who had the ability to bring down a commercial airliner if they felt that the need had arisen?
Apparent that capability exists and in my opinion, that is a scary thought. Not to mention that it is a more than questionable authority that the capability is being based on.
NYPD has capability to shoot down planes.
The chief of the New York Police Department says city police could take down a plane if needed. Commissioner Ray Kelly tells CBS' "60 Minutes" that after the Sept. 11 attacks, he decided the city couldn't rely on the federal government alone. He set about creating the NYPD's own counter-terrorism unit. He says the department is prepared for multiple scenarios and could even take down a plane. Kelly didn't divulge details but said "obviously this would be in a very extreme situation." Other measures include sending NYPD officers abroad, using radiation detectors and creating a network of surveillance cameras in Manhattan. The interview airs Sunday evening. It comes just a few weeks after the tenth anniversary of 9/11, when hijackers flew planes into the World Trade Center and Pentagon.

And though he didn't say it directly, for a second term, too. Obama's speech to the annual awards dinner of the Congressional Black Caucus was his answer to increasingly vocal griping from black leaders that he's been giving away too much in talks with Republicans -- and not doing enough to fight black unemployment, which is nearly double the national average at 16.7 percent.
"So, I don't know about you CBC, but the future rewards those who press on! With patient and firm determination, I'm gonna press on for jobs! I'm gonna press on for equality! I'm gonna press on for the sake of our children! I'm gonna press on for the sake of all those families who are struggling right now! I don't have time to feel sorry for myself! I don't have time to complain, I'm gonna press on! I expect all of you to march with me and press on! Take off your bedroom slippers, put on your marching shoes! Shake it off! Stop complaining! Barack Obama's message to blacks across America appears to be: "shut up and march." Pay no attention to what I told you three years ago, press on! No one told you this was going to be easy, press on!

Disregard what them white people are telling you with their polls, press on! Shut up and march and help me push this jobs bill through congress and then you can help me get reelected. During his campaign and during his presidency, Barack Obama has frequently brushed up closely to the famous tone and oratory stylization of Martin Luther King, but in my opinion, he has yet until now come close to attempting a full on parody of the man.
With this speech to the congressional black caucus, I believe the parallels are undeniable. The references to King and John Lewis aside, Barack Obama is preaching in this speech. He his fire branding his position to his base and he is clearly sending a message. He is in a battle and he doesn't have time for shirkers. The CBC and those who march to their orders need to understand and recognize that Barack Obama and his plans for this country are larger than their mere individual and collective discomforts.
John Lewis got beaten within an inch of his life on Sunday according to this president and on Monday he was marching. The metaphors are incessant in this speech, but equally important is the tone and the delivery of the message. Barack Obama isn't just mad and upset at the republicans that he is railing against over his jobs bill, he is equally angry with those he is addressing for their backsliding and failure to blindly support his policies, not to mention calling him to task to explain himself to them.
I have watched the speech several times now and listened to the words and the manner in which they were delivered. The eye contact, the body language and the posture of his tone denote a man who is tired of having to re-explain himself. And at the end of the speech, the podium slap emphasizes his disgust with having to take away form his precious time to come and re-explain himself to the plantation.
Barack Obama doesn't have time to feel sorry for himself and he doesn't have time to complain, but more importantly, he doesn't have time to listen to black Americans feeling sorry for themselves or complaining. Barack Obama is telling them, don't invite me to your pity party, cause I ain't coming! I've got far more important things to do, far more important things to accomplish! And you people need to get with the program! You need to disregard your own personal suffering and stop complaining to me about it, Save your grief and aggravation for the white man, cause I ain't listening. I don't have to listen. You can't call me racist, so I don't care what you think or what you want.

Liberal filmmaker Michael Moore has called for an economic boycott of the state of Georgia to protest Wednesday's execution of Troy Davis, the Savannah man convicted of murdering an off-duty police officer in 1989. "I encourage everyone I know to never travel to Georgia, never buy anything made in Georgia, to never do business in Georgia," Moore wrote on his website in a blog item posted a few hours after Davis' death. "I will ask my publisher to pull my book from every Georgia bookstore and if they won't do that I will donate every dime of every royalty my book makes in Georgia to help defeat the racists and killers who run that state. I am sorry. Maybe it's just me? But I don't see Pakistan as an ally. I don't see Pakistan as ever having been an ally. They are next door neighbors to Afghanistan and they have been harboring the Taliban since day one in the war on terror. It's yet another humorous gaffe by the Harvard graduate, overlooked by most media for whatever reason. Like Obama saying Abraham-Come-Lately Lincoln was the founder of the Republican Party. Or Navy corpseman. Or the Austrian language. Fifty-seven states. The president of Canada. Etc.
If you talk as much as this guy likes to talk instead of governing, if you believe you are a Real Good Talker as much as this guy does, you're gonna blow a few lines. But this many?

The left wasted little time launching their allegations of bigotry against the GOP based upon the question of a homosexual soldier submitted to Rick Santorum last night.
On last nights debate
Before I delve into the days news and other issues, last night's GOP debate should be examined briefly. Who do I think won? In all fairness, no one won. The debate last night wasn't about winning. The debate was about going after the acknowledged front runner and pushing the media desired candidate as opposed to the one doing the best in the polls. Everything else was smoke and mirrors and designed solely for those two purposes.
Two debates ago, Newt Gingrich hit the nail squarely on the head when he saw the game being played by the media. The game is to get the candidates to publicly fighting and to turn the entire debates into some media controlled spectacle. Even Rick Santorum noted last night that he wondered who would ultimately prevail, after Perry and Romney have pummeled themselves into oblivion. In the mean time the people suffer, as there is no serious attempt to show the people who the best leader potentially is.
These debates are media orchestrated and they are not informative. Rather than seeing the candidates showcase their proposed platforms and leadership skills, what we are seeing is a choreographed street fight. And everyone of the GOP candidates is going along with it aside from Gingrich. Having watched all of these debates so far, my opinion is that all that has been accomplished to date, is to cause me to sour on everyone one of them save Gingrich and I like his positions on calling out the media for their contrived circus more than anything else.
If I want to watch fights, I will tune in the WWA or MMA on cable. I am interested in hearing fresh ideas and seeing people demonstrate their records and leadership skills. I am not interested in sitting through these bashings and cut throat gotcha questions and cute quips.
This is our future these people are discussing and it is important to me. Stop the staged drama and stick to the problem of getting this country moving again. Or else concede another four years to the present administration.

Texas inmates who are set to be executed will no longer get their choice of last meals, a change prison officials made Thursday after a prominent state senator became miffed over an expansive request from a man condemned for a notorious dragging death. Lawrence Russell Brewer, who was executed Wednesday for the hate crime slaying of James Byrd Jr. more than a decade ago, asked for two chicken fried steaks, a triple-meat bacon cheeseburger, fried okra, a pound of barbecue, three fajitas, a meat lover's pizza, a pint of ice cream and a slab of peanut butter fudge with crushed peanuts. Prison officials said Brewer didn't eat any of it.
"It is extremely inappropriate to give a person sentenced to death such a privilege," Sen. John Whitmire, chairman of the Senate Criminal Justice Committee, wrote in a letter Thursday to Brad Livingston, the executive director of the Texas Department of Criminal Justice. Within hours, Livingston said the senator's concerns were valid and the practice of allowing death row offenders to choose their final meal was history. "Effective immediately, no such accommodations will be made," Livingston said. "They will receive the same meal served to other offenders on the unit." That had been the suggestion from Whitmire, who called the traditional request "ridiculous." "It's long overdue," the Houston Democrat told The Associated Press after he was informed of Livingston's decision.

91-year-old Albert Einsig threw urine on sidewalk to keep kids away
A 91-year-old Pennsylvania man is cited for throwing urine on the sidewalk to keep neighborhood kids off his property. Our sister station WHP CBS 21 talked to this man, who admits to doing this. But he says he feels like he had no other choice. Albert Einsig says he has never had problems this bad with teenagers in his neighborhood. He also says he just wants those teens to leave him alone. "You know how long I live in this house? 63 years! 63 years!" Einsig explained. Until recently, Einsig was happy in his East Clark Avenue home. But lately, he says he's been kept up all night by neighborhood teens hanging out on his porch. He put up sheets to stop them from peering in, but still they antagonize him. "They bang on the door, bang bang, to get me out of bed," Einsig stated. He says the handicap sign in front of his home is what's behind the taunting. So that's why, at his wits end, the 91-year-old dumped a bucket with urine in it on his porch and down to the sidewalk. "Someone on the street out of all the people hollered 'That's a piss bucket!' Then that word got spread around to all the people out there!" Einsig commented.

Troy Davis finally set to die (UPDATED)
Of Smoke and Mirrors
This evening at 7 PM, barring last minute intervention by the courts or reprieve by the state board of pardons and paroles, Troy Davis will be executed in Georgia's death chamber. This case has been reviewed and appealed for twenty years, but it has suddenly taken on celebrity status with the national media today. Even FOX News has gotten in on the act to tout the supposed questions that seemingly now exist concerning Troy Davis conviction and sentence. Questions not the least of which seem to be, the supposed recantation of the testimony of seven witnesses and the lack of a murder weapon.
Troy Davis was convicted in 1991 of murdering Savannah police officer Mark MacPhail. The jury that heard the case was comprised of seven black and five white jurors. The jury took less than two hours to arrive at their verdict after seeing the evidence and hearing the witnesses.
During the trial a number of witnesses testified to their incriminating observations of Troy Davis the night of the murder and their subsequent conversations with Troy Davis after the MacPhail murder. Two of those witnesses testified that Troy Davis admitted to them that he had shot and killed officer MacPhail the night of the murder.
The Georgia Bureau of Investigation matched the shell casings from officer MacPhail's crime scene to those recovered from another victim that Davis had shot earlier on the evening. There is no question or doubt that Davis shot the other man, but because he disposed of the weapon after murdering officer MacPhail, there is now an allegation that the evidence doesn't support his conviction of the MacPhail murder.
It seems that once again on the eve of an execution, there is a large cadre of celebrities and those involved in the anti capital punishment movement, who have garnered national media attention via their use of publicity and smoke and mirrors to attempt to prevent the Davis execution.
Their contention being that there is no gun to support the evidence and that seven of the original witnesses against Troy Davis have now changed their statements. In actuality what these witnesses have done is to now state that they were supposedly coerced by police and prosecutors into making their written statements twenty two years ago. Yet two years after they made those statements, (during the first rounds of the Davis appeal and review of evidence) they each swore in affidavits that their statements were true as written when they signed them. Yet now, they allege that the "police typed the statements and they never read what they signed." Therefore, they supposedly had no idea, either then, during the trial or in the twenty odd years since, that the police and prosecutors had some how misstated or misconstrued their statements.
That would seem to be a major problem for those seeking to have Troy Davis' death sentence commuted. It would seem to be the ultimate legal game changer literally screaming for the sentence to be set aside and commuted to life. Except for a few facts that are being overlooked of course.
First, it is common practice for police typist to type the written statements of all witnesses to a homicide. The statements are then presented to the witnesses for reading and review prior to their signing. If anything is wrongly stated or in error, the witness can request that it be corrected. If the person is incapable of reading and writing, the statement is read to them and the same thing applies.
The problem with an allegation that the witness statement is inaccurate or does not reflect what the witness actually said, (at this late date) is that while a mistake can be made concerning syntax or punctuation or even word usage, the material facts of the statement don't mysteriously change to a complete recantation of what was originally reported or stated. Especially in light of the fact that at least two years after the fact, the witnesses involved in Davis prosecution each swore that what they had signed as their official statements, were true and accurate accounts of what they witnessed, heard and reported to police concerning the conviction of Troy Davis.

Many people are concerned that an innocent man is about to be put to death. I know this, and I understand it. I am not likewise concerned, however, and I want to explain why. The only information the public has had in the 17 years since Troy Davis' conviction has been generated by people ideologically opposed to the death penalty, regardless of the guilt or innocence of the accused.
While they have shouted, we have been silent. The canons of legal ethics prohibit a lawyer - prosecutor and defense counsel alike - from commenting publicly, or engineering public comments, on the issue of guilt or innocence in a pending criminal case. Now that the U.S. Supreme Court has ruled, the case is over, and I can try to tell our side.
First , Davis' advocates have insisted that there was no physical evidence in the case. This is not true. Crime lab tests proved that the shell casings recovered from the shooting of Michael Cooper at a party earlier in the evening were fired from the same weapon as the casings recovered from the scene of Officer Mark MacPhail's murder.
Davis was convicted of shooting Cooper. And, while it isn't physical evidence, consider the "testimony" of Officer MacPhail himself: When he comes to the rescue of a homeless man being harassed and pistol-whipped, the officer ran past Sylvester Coles on his way to catch Davis. This makes Davis the only one of those two with a motive to shoot Officer MacPhail. Yet Davis' lawyers argue to condemn Coles for shooting MacPhail. Why would he?
In fact, Davis' advocates are eager to condemn Coles based on evidence far weaker than their characterization of the evidence against Davis. Where is their sense of fairness? This is the same Sylvester Coles who promptly presented himself to police, and who was advised by counsel to tell all that he knew - with his lawyer not even present. Which he did. No lawyer who even faintly suspects a client of criminal conduct would let him talk to the police without counsel.
Second , they claim that seven of nine witnesses have recanted their trial testimony. This is not believable. To be sure, they've produced affidavits; a few handwritten and apparently voluntarily and spontaneous, except for concluding with "further the affiant sayeth not." Who wrote that stuff? The lawyers, perhaps? The law is understandably skeptical of post-trial "newly-discovered evidence." Such evidence as these affidavits might, for example, be paid for, or coerced, or the product of fading memory.
If every verdict could be set aside by the casual acceptance of a witness's changing his mind or suggesting uncertainty, decades after the event, it is easy to see how many cases would have to be tried at least twice (perhaps ad infinitum). Thus the law sets strict standards for such "newly discovered" evidence. For example, it cannot be for a lack of diligence that the new evidence was not discovered sooner, and the defendant is expected to present that evidence at the earliest possible time.
Yet these affidavits were not offered in a motion for new trial until eight days before the first scheduled execution in 2008 seventeen years after Davis' conviction. If this affidavit evidence was so compelling, why didn't they rush to seek a new trial in 2003 when they had most of the affidavits they now rely upon? Or collect those affidavits earlier?
Each of the now-"recanting" witnesses was closely questioned at trial by lawyers representing Davis, specifically on the question whether they were in any way pressured or coerced by police in giving their statements or testimony. All denied it. And while an 80 percent recantation rate - the first in the history of the world ? - may seem to some as overwhelmingly persuasive, to others of us it invites a suggestion of uncanny coincidence, making it very difficult to believe.
Third , they claim that their "newly discovered evidence" (i.e., the recantations) hasn't been adequately considered by the courts. This is not true. The affidavits, in various combinations, had already been reviewed by 29 judges in seven different types of review, over the course of 17 years, before Tuesday's ruling by the U.S. Supreme Court. The state Parole Board halted the execution in 2007, saying they wouldn't allow a possibly innocent man to be executed. Then, after more than a year of reviewing all of the evidence on both sides, and hearing from every witness Davis' lawyers presented - including Davis - they refused to grant clemency.
The trial was fair. Davis was represented by superbly skilled criminal defense lawyers. He was convicted by a fair jury (seven black and five white). The post conviction stridency we've seen has been much about the death penalty and little about Troy Davis. The jury found that Davis, after shooting another man earlier in the evening, murdered a police officer who came to the rescue of a homeless man Davis had beaten.
Mark MacPhail had never even drawn his weapon.

At approximately 11:08 PM last night, Troy Davis was finally executed for the murder of Officer Mark MacPhail. "Journalists" present, reported that Davis' last words were a continuation of his denials of guilt and a request that God have mercy on the souls of those responsible for his execution.

Gunmen dump thirty five bodies on the street
Masked gunmen blocked traffic on a busy avenue in a Gulf of Mexico coastal city Tuesday and dumped the bodies of 35 slaying victims as horrified motorists watched, authorities said. Veracruz state Attorney General Reynaldo Escobar Perez said the bodies were left piled in two trucks and on the ground of an underpass near a shopping mall in the city of Boca del Rio.
Police had identified seven of the victims so far and all had criminal records and were linked to organized crime, Escobar said. He didn't say to what group the victims belonged to. The Gulf and Zetas drug cartels have been locked in a bloody war for control in Veracruz state over the last year.

The 85-year-old Grammy-winning crooner, famed for the 1960s hit single "I Left My Heart in San Francisco" appeared on the Sirius XM Radio talk show in New York to discuss his latest album "Duets II."But he also ended up talking about his antipathy to war, borne out of his experience serving as an infantryman in Europe in the last two years of World War II."But who are the terrorists? Are we the terrorists or are they the terrorists? Two wrongs don't make a right," Bennett said talking about the aftermath of the 2001 attacks on the World Trade Center.The singer, who has sold more than 50 million records, disagreed with Stern's assertion that the Twin Towers attacks led to US military action in Iraq and Afghanistan."They flew the plane in, but we caused it," Bennett said. "Because we were bombing them and they told us to stop."

Yep, homosexuality in the American military is now an accepted practice. It's only fair right? If you have listened to the egalitarian mantra of the past three decades, it most certainly is an issue of fairness. Nothing more.
Well, I for one disagree and I for one see an exodus from our military as a result of it. Of course over time, as more and more of our children are indoctrinated into the egalitarian fold, the practice will fade from memory and truly become an accepted practice in our military. But at what price.

After years of debate and months of final preparations, the military can no longer prevent gays from serving openly in its ranks. Repeal of a 1993 law that allowed gays to serve only so long as they kept their sexual orientation private took effect Tuesday at 12:01 a.m. EDT.
Some in Congress still oppose the change, but top Pentagon leaders have certified that it will not undermine the military's ability to recruit or to fight wars. The Army was distributing a business-as-usual statement Tuesday saying simply, "The law is repealed," and reminding soldiers to treat each other fairly.

I believe the headline says it all. Finally, voices in the black community are saying what a good many blacks know to be the truth. This president has been the absolute hands down worst for helping blacks in America. The worst ever. And now they are waking up to that reality.

"There is a less-volatile reaction in the CBC because nobody wants to do anything that would empower the people who hate the president."
Right now, 'right now' means sometime next month maybe
It's another beautiful day in the neighborhood. Or SSDD or Ground Hog day, depending on how you view it. Over the weekend the EU continued to shudder, Greece continues to spiral into collapse and Obama is headed for another vacation. Meanwhile, Medal of Honor recipient Dakota Myer, was given the honor of ringing the opening bell on Wall Street this morning. And as I watched, the market dropped 170 points in the first minute of opening.
I say it's about time for the president to head back over to Five Guys and order another cheeseburger in paradise.
Everybody remembers the urgency of President Obama's attitude toward the awful jobs situation. Back in early August, Obama said the jobs situation was so urgent that he was going to give another speech about it -- in a month or so, in September after his vacation on Martha's Vineyard. And then in September the president announced he would give his major jobs speech to a joint session of Congress on Sept. 7. But he neglected to check with congressional leaders first. And they suggested the 8th. So, since it was their House, the 8th it was. "Tonight," the president said in the first 34 of his 4,021 words to a national television audience that night, "we meet at an urgent time for our country. We continue to face an economic crisis that has left millions of our neighbors jobless, and a political crisis that has made things worse."

This could spark riots
This is one of those headlines that just screams: "Ya Think?"
This story broke last week as it concerns Mayor Bloomberg's assessment of the situation and yet mainstream media just let it float on by. Little notice was paid and less commentary was offered as it concerned the Mayor of New York and his misgivings concerning a potential societal collapse in this country.
But the reality is more than chilling to those like myself. Those who have see the proverbial 'writing on the wall' for at least the last generation. America can no longer sustain the house of cards that our brand of modern day socialism has wrought. We can't pay for it and worse, we can't pay for what we have already obligated ourselves to.
And finally, even those on the liberal fringe are beginning to talk in murmurs of the what ifs of the reality. Bloomberg may have run as a republican, but he is as far from conservatism as one can possibly be. Yet he sees the problem and is sounding the warning. Albeit too late IMO.

Bloomberg: Jobs crisis could spark riots here
New York City Mayor Michael Bloomberg is worried that high U.S. unemployment could lead to the same kind of riots here that have swept through Europe and North Africa. "You have a lot of kids graduating college, [who] can't find jobs," said Bloomberg, during his weekly radio show on Friday.
"That's what happened in Cairo. That's what happened in Madrid. You don't want those kinds of riots here." That was the mayor's response when asked about the poverty rate, which rose to 15.1% in 2010, its highest level since 1993, according to census data released Tuesday. About 46.2 million people are now living in poverty, 2.6 million more than last year.
"The public is not happy," he said. "The public knows there is something wrong in this country, and there is. The bottom line is that they're upset." Riots have gripped various countries in European cities, including Athens and London, fueled by young people infuriated by high unemployment and austerity measures, which in some cases has led to looting. High unemployment among youth is also one of the driving forces behind the Arab Spring, as impoverished protestors in North Africa and the Middle East rose up against their heavy-handed governments.
"The damage to a generation that can't find jobs will go on for many, many years," said Bloomberg. The mayor, an independent, criticized the partisan politics that have stymied progress in Congress, and the inability of Republicans and Democrats to compromise on ways to fix the economy.
Paul wins straw in California
So let's review. Not only is California the land of fruits and nuts as it concerns liberals? But they also have their conservative loons who apparently carry on in a similar tradition.
GOP presidential hopeful Ron Paul wins California straw poll Texas Rep. Ron Paul won a California straw poll, the state Republican Party announced in a statement Saturday night. A total of 833 ballots were cast during the straw poll, the statement said. Paul won with 44.9% of the votes, Texas Gov. Rick Perry came in second with 29.3% of the votes, and former Massachusetts Gov. Mitt Romney came in third with 8.8% of the votes. The California Republican Party, associated members and registered guests were allowed to vote in the straw poll, according to the statement. Paul was scheduled to give speeches in Los Angeles on Saturday, including the keynote at the Republican Liberty Caucus of California. He has gained momentum in the race for the White House in recent weeks, according to the latest CNN/ORC International Poll. Among current GOP candidates, Paul placed third in the poll with 13%, following Romney in second place with 21% and Perry in first with 32%.

Denver Men Accused of Taking Friend's Corpse on Boys' Night Out Two Colorado men stand accused of multiple offenses after driving their dead friend's corpse to a pair of Denver nightspots and using his ATM card to buy themselves drinks, the Denver Post reported Thursday. Prosecutors have charged Robert Jeffrey Young, 43, and Mark Rubinson, 25, with abusing a corpse, identity theft and criminal impersonation. The men found their friend Jeffrey Jarrett unresponsive at his house late on Aug. 27, before loading him into Rubinson's car and taking him to a local bar and grill, where they drank on his tab. They then went to another bar, before returning Jarrett's body to his home and continuing their night out using their dead friend's ATM card to withdraw money. On their way home, they flagged down a cop and told him they thought their friend was dead at his house. Neither Young nor Rubinson has been charged with Jarrett's death, the cause of which is still to be determined. "This is a bizarre and unfortunate crime," said Denver Police Department spokesman Sonny Jackson. "This isn't anything you want to have happen to a loved one. You want them treated with respect in death."

So let's review: Four white men are attacked by a gang of black and Hispanic teenagers and the "motives are unknown."
I agree, completely baffling isn't it. A crime like this hasn't occurred in America in what? Several weeks?

NFL wants pat downs from ankles up at all stadiums
I am sorry, but I have to honestly say, that short of my winning the lottery and being able to charter my own aircraft? I probably won't be flying anytime again for the remainder of this lifetime. And it looks like the same may soon be true as it applies to NFL games and God knows what else they are dreaming up.
I simply refuse to be subjected to this type of insanity in order to satisfy the illusion of safety. And I am equally opposed to the idiocy of the adage that: "this is simply the price we must pay to live in a free society." We lived in a free society for most of my life before this idiocy arrived and I presently am worried about what that definition really means anymore.
I have been to one NFL game in my life and I can honestly state from memory that it wasn't an experience that I would be willing to forfeit my personal rights for to experience again. This latest revelation by the NFL speaks more to the idiocy of our present reality, than any need for increased security.
How long before they will want to institute search policies just about every where you go? Maybe it's just me? But I say hell no! Police and properly punish those responsible for crime and murder and mayhem and relatively quickly their ranks will dwindle to nothingness.
I refuse to be the prisoner of a police state.
NFL wants pat downs from ankles up at all stadiums
The NFL wants all fans patted down from the ankles up this season to improve fan safety.It's not bad enough that air travel in this country has gone from absurd to completely ridiculous. but now comes the NFL wanting to implement similar searches of everyone attending football games.
Previously, security guards only patted down fans from the waist up before gaining entry to NFL stadiums. Under the new "enhanced" pat-down procedures, the NFL wants all 32 clubs to search fans from ankles to the knees as well as the waist up. The stricter security approach impacts the 16.6 million fans expected to attend live regular season NFL games this season.

New Jobs claims jump unexpectedly
The headline on Drudge this morning, is that "new jobs claims jump unexpectedly." I have a question.....What the hell makes people think that this is unexpected? President Obama's Jobs program? The additional 450 billion that we don't have and will have to borrow? That was supposed to fix everything? Rules of Engagement
Tomorrow there will be a ceremony at the White House. Former US Marine sergeant Dakota Myer will be there to accept the nation's highest honor for his bravery of action two years ago in Afghanistan. But at home with four other families, the families who lost their loved ones that day, the pain of what happened that day will never go away. And at least one of the mothers knows who is truly responsible for her son's death.
The bottom line, these young men dies just as this gold star mother says. They died at the mercy of abject political correctness and the absence of leadership by their superiors. Barack Obama established these rules of engagement and Generals McChrystal and Petreaus have dutifully led hundreds to their death in Afghanistan as a result of them.
Attack Watch
Yesterday the White House opened a web site named "Attack Watch." Since it opened, it appears to have changed. It has gone from it's first offering, where a list of drop down boxes gave the options of reporting news media and printed articles that are suspect (among others) to where it is now a membership site only. apparently, you have to join the site to see the internal workings.
Needless to say, this is not something that is associated with Homeland Security, but rather a element being put forth by "Obama for America." A political arm of the president's re-election campaign and efforts.
24 hours ago this is what you got by going to their site.
Now all you get is the opportunity to join and become one of their snitches.
This will be worth keeping an eye on.
Gray Lady Down
On Sunday during the observance of the tenth anniversary of 9/11, something despicable occurred. Paul Krugman, a so called columnist for the New York Times wrote and the Times published, an absolutely despicable and unwarranted column denouncing the anniversary and those historically involved as having cashed in.
The utter audacity of the man was the final caveat of his slanderous piece, where he added that for obvious reasons, he was not going to allow any commentary to what he had written. Well i for one voiced my opinion, as I took the time to do the research and locate Mr. Krugman's email. After which I voiced my opinion to him whether he wanted it or not and told him what a despicable coward he was.
NY Times must share the blame, disgrace
The Ol’ Gray Lady ain’t what she used to be! On Sunday, New York Times [NYT] columnist and left-wing economist Paul Krugman set off a firestorm when he blithely referred to the 9/11 anniversary as “an occasion for shame.” That’s right, “an occasion for shame.” Why? Because “fake heroes” like then New York Mayor Rudy Giuliani and President George W. Bush “hijacked” the day in an attempt to “cash in” on the atrocities. In typical paranoid fashion, Krugman seems to believe that Giuliani and Bush took some maniacal pleasure in the attacks on our country — the better to consolidate their power. (Insert evil Halloween laugh track.)Subsequently, the media has taken note that former Secretary of Defense Donald Rumsfeld's reaction to the column was to cancel his subscription to the New York Times. I say good for him. I wish several thousand more would do the same. But I can't help but wonder. Why do people still have and pay for subscriptions to the New York Times or any other literal rag reporting service. There are far too many better sources of unadulterated news reporting on the internet for free. So, if nothing else good comes from Mr. Krugman's arrogance, then I sincerely hope that the end result is a noticeable decline in their paid readership. AS for me? I get my slivers of slime and fecal smearing known as New York Times reporting via other sources on the internet. I have never subscribed to the rag and never will. I haven't bought any newspaper in over twenty years now and I don't plan to at this point in time. I can gain access to all the leftist anti American vitriol I need on a free basis on the internet and I don't have to subsidize their efforts by paying for it.

President Barack Obama is moving at a historic pace to try to diversify the nation's federal judiciary: Nearly three of every four people he has gotten confirmed to the federal bench are women or minorities. He is the first president who hasn't selected a majority of white males for lifetime judgeships. More than 70 percent of Obama's confirmed judicial nominees during his first two years were "non-traditional," or nominees who were not white males. That far exceeds the percentages in the two-term administrations of Bill Clinton (48.1 percent) and George W. Bush (32.9 percent), according to Sheldon Goldman, author of the authoritative book "Picking Federal Judges." "It is an absolutely remarkable diversity achievement," said Goldman, a political science professor at the University of Massachusetts at Amherst, who is only counting judges once, even if they fit more than one category. The White House recently has been touting its efforts to diversify the federal bench during Obama's tenure, now approaching three years in office. The president won Senate confirmation of the first Latina to the Supreme Court, Justice Sonia Sotomayor. With the confirmation of Justice Elena Kagan, he has put three women on the high court for the first time. The Obama administration also nominated and won confirmation of the first openly gay man to a federal judgeship: former Clinton administration official J. Paul Oetken, to an opening in New York City. "All of us can be proud of President Obama for taking this critical step to break down another barrier and increase diversity in the federal judiciary," Sen. Romney definitely looked better and Perry definitely took hits on his support of the HPV vaccine in Texas and his immigration stance. Romney looked more in control than Perry to me last night.
Gingrich continues to make the most of the few opportunities that they are giving him and is consistently more in tune with the facts and the history, while Bachman definitely was determined to be more aggressive last night and she was. Poor Herman Cain is out of his depth and Ron Paul remains the Everready bunny of the libertarian looney limits.
But no one won last night. Regardless of what the 'slam polls' may say about Ron Paul again this morning.

Road crews! and Diggers! and Pavers! Oh! My!
This is an excerpt from the president's speech on his jobs package earlier today. Taken directly from the White House web site.

Taxes, taxes and more taxes.....
Another SSDD moment from this president. He finally blesses us with his great and wondrous jobs plan last Thursday and what do we get? SSDD. Taxes, that is the only thing that liberals know. They do not know how to cut back on anything. Be it regulations, taxes, or spending.
And they definitely don't know how to create jobs, only kill jobs.
Obama Seeks to End Tax Breaks to Pay for Jobs Plan President Barack Obama would pay for his $447 billion jobs plan by ending a series of tax breaks for oil and gas companies, hedge-fund managers and people making more than $200,000, the White House said Monday. In total, Mr. Obama's plan would end about $467 billion of tax breaks over 10 years, said White House Office of Management and Budget Director Jack Lew. The president has previously proposed ending the tax breaks, but has faced stiff resistance from Republicans. By choosing to end the tax breaks, the White House is likely setting itself up for a fight with Republicans. Over the summer, Republicans said they wouldn't end tax breaks amid concerns doing so as the U.S. is coming out of a recession would hamper the recovery. "It would be fair to say this tax increase on job creators is the kind of proposal both parties have opposed in the past," said Brendan Buck, a spokesman for House Speaker John Boehner (R., Ohio). He continued, "We remain eager to work together on ways to support job growth, but this proposal doesn't appear to have been offered in that bipartisan spirit." The White House disputed the notion that raising taxes on the wealthy would hurt growth. The measures to pay for spending "are spread out so that there aren't negative impacts," said White House press secretary Jay Carney. The White House is also taking a gamble that Republicans are willing to budge on taxes after getting bruised, politically, over a tough budget fight in the summer.Forget about creating jobs, the man is a straw man. A Trojan Horse. There is nothing tangible about him or his thinly veiled Fabian socialist programs. Nothing has changed. All he is interested in is spending more money that we don't have and taxing the "evil rich" until they no longer exist. And the news today? The president's own deficit reduction committee is already rolling their eyes and shaking their heads. They haven't even begun to attempt to make cuts yet, and the man just dumped another 450 billion in their laps with the caveat to "just raise taxes!" If it walks like a duck, looks like a duck and quacks? It must be an Obama policy to attempt to conceal another attempt to raise taxes and further ruin the economy and the future of this country.

They are surprised at her candidness? Why? That is the way real people of that era thought. The only difference being, she knew that her words would never be heard until long after her death. And she was right on all counts IMO.
